Various articles of The Roads (Northern Ireland) Order 1993 enable the Department to consent to or control excavation on or near a road or the erection of certain structures on a road such as walls, fences, scaffolding, etc. Application forms are available online for applicants to print, complete and post to their local Department for Infrastructure (DfI) Roads office, who assess and process the application.

Why are you processing my personal information?

  • Our lawful basis for processing your personal data is under the UK GDPR Article 6(1) (c) and Article 6(1) (e).
  • To effectively assess, process and manage your application and any subsequent Departmental consent or refusal of consent.
  • For a Traditional Arch application under Article 73 of The Roads (Northern Ireland) Order 1993 only - in order for the Department to consider whether a refusal to grant consent would be in contravention of Section 6 of The Human Rights Act 1998.

What categories of personal data are you processing?

  • Personal data – including your name, address, telephone number, email address.
  • Special category personal data – for Traditional Arch applications only, information relating to religious organisations. Our lawful basis for processing special category data under the UK GDPR is Article 9(2) (a) and Article 9(2) (b).

Do you share my personal data with anyone else?

Yes. If we have to initiate legal action under the Roads (NI) Order 1993 where works have been carried out without consent or for failure to adhere to any conditions placed on the consent, it may be necessary to share your personal information with the Department’s legal representatives.

Article 73 Traditional Arch applications - Under Section 6 of the Human Rights Act 1998, it is unlawful for the Department to act incompatibly with any of the protected rights under the European Convention for Human Rights. For Traditional Arch Applications, in order for the Department to inform itself as fully as possible and to avoid infringing Section 6 of the Act, it may be necessary to seek views or information from local community/political representatives, the PSNI and perhaps others in appropriate cases.

As such, the Applicant’s personal data and/or special category personal data may be shared as described.
