Rail Safety Branch acts as the Rail Safety Authority, (RSA) for Northern Ireland operating within the Department for Infrastructure. RSA is responsible for ensuring the safe operation of the railway infrastructure and rail operations in Northern Ireland including the train driver Licensing functions and railway certification functions.

Why are you processing my personal information?

  • In connection with the Branch’s function as the rail safety authority; the rail licensing and certification authority and the Train Driver Licensing Authority for Northern Ireland it is required to retain information to ensure the safe operation of the rail system.
  • In connection with the Branch’s duties as part of the legislative process including its duties under the Freedom of Information Act 2000 (FOIA) or the Environmental Information Regulations (EIR).

What categories of personal data are you processing?

  • Personal data – including your name, postal address, email address and/or telephone number. Our lawful basis for processing this under the UK GDPR is Article 6(1)(c) and 6(1)(e).
  • In the case of data provided in connection with the Branch’s function as the rail safety authority; the rail licensing authority or as the train driver licensing authority, the Train Driver Licensing and Certificates Regulations (Northern Ireland) 2010 (as amended) (S.R. 2010 No. 132), our lawful basis for processing this under the UK GDPR are Article 6(1)(c) to 6(1)(e).
  • Personal data – in connection with the Branch’s function as the RSA; (The Railway Safety Act (Northern Ireland) 2002, (2002 c.8), the rail licensing/ certification authority and the train driver licensing authority for Northern Ireland details of training, skills, and experience in addition to your personal data provided by either yourself or your employer.
  • A register of Doctors and Psychologists registered for the purpose of carrying out medical and occupational psychological fitness examinations under the Train Driver Licensing and Certificates Regulations (Northern Ireland) 2010 (as amended).

Where do you get my personal data from?

  • Your information would be supplied by you to the Department in connection with railway safety functions or in connection with train driver licensing requirements.
  • Your information would be supplied by you or your employer to the Department in connection with the Branch’s function as the RSA and the rail licensing authority for Northern Ireland or its function in developing policy and related legislative measures in connection with railway safety.

Do you share my personal data with anyone else?

  • This information is retained by the Department for its sole use unless the matters referred to in your correspondence are more appropriately dealt with by a third party. In such circumstances you will be asked if you wish to contact them directly or whether you wish the Department to pass your correspondence to them on your behalf.
  • In the case of data provided in connection with the Branch’s function as the rail safety authority and the rail licensing authority for Northern Ireland information may be provided to the rail authorities in Great Britain, the Republic of Ireland or at your request with rail authorities elsewhere.

Do you transfer my personal data to other countries?

  • No except in the case of data provided to the rail authorities as referred to above.

  • You have the right to access to your personal data.
  • You are entitled to have personal data rectified if it is inaccurate or incomplete.
