The Parking Enforcement Processing Unit, which is part of the Department for Infrastructure, is responsible for issuing and enforcing Penalty Charge Notices (PCNs) for parking contraventions and moving traffic offences that occur within Northern Ireland. The legislative basis for this function is the Traffic Management (Northern Ireland) Order 2005.

Why we process your personal information

We hold your personal data when you submit an informal challenge against the issue of a PCN either in writing or online through NI Direct. This consists of your name and contact details and may also contain special category personal data such as medical evidence in relation to yourself or others in support of your challenge. This data is required so that we may consider the circumstances outlined in the challenge and any evidence supplied in support of the challenge.

If the PCN remains unpaid after the end of the 28 day payment period, the legislation makes provision for the vehicle keeper name and address details to be sought from the Driver and Vehicle Licensing Agency (DVLA) so that a Notice to Owner document can be issued to the vehicle keeper.

For vehicles registered in the Republic of Ireland, keeper details are sought from the Driver and Vehicle Computer Services Division of Ireland’s Department for Transport.

Body Cameras

When a PCN is issued by a Traffic Attendant, a body camera may have been activated. If this is the case and the PCN has been paid, any footage held will be deleted after 3 months. If the PCN remains unpaid, the footage may be retained until the PCN has been closed as it may be required for appeal purposes.

Who we may share your personal information with

• The legislation makes provision for PCNs to be appealed to the independent Traffic Penalty Tribunal, which is run by the Department of Justice. If the PCN is appealed to the independent Traffic Penalty Tribunal, an Adjudicator will be provided with all of the information relevant to the PCN. This is also provided to the appellant.
• If the PCN remains unpaid, the legislation makes provision for the recovery of the debt either through the Enforcement of Judgements Office, or through clamping of the vehicle by the Enforcement Contractor. The Enforcement of Judgements Office may be provided with any of the personal data that is held in order to assist with recovery of the debt. The Enforcement Contractor may be provided with the name and address of the vehicle keeper.
• If a crime is detected or suspected, information may be shared with PSNI.

How long your personal data may be kept

The Department has a Retention and Disposal of Records schedule. This requires that the information relating to your PCN will be deleted 3 years after the PCN has been paid and closed. Vehicle keeper details are redacted 6 months after the PCN has been paid and closed.

Your rights

• You have the right to obtain confirmation that your data is being processed, and access to your personal data;
• You are entitled to have personal data rectified if it is inaccurate or incomplete;
• You have the right to object to the processing, in specific circumstances.
